1. Introduction

These Terms of Service (“TOS” or “Terms”) govern your access to and use of the Expert Comments website (https://expert-comments.com and all its subdomains) and its associated services (collectively, the “Service”). The Service is operated by Machine Mind Ltd, registered office at 35 Follager Road, CV21 2JF Rugby, United Kingdom, a Private Limited Company legally registered in England and Wales (company number 11731290) (“Expert Comments,” “we,” “us,” or “our”).

By accessing or using the Service, you (“User,” “you,” or “your”) signify that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

3. Service Description

3.1 Nature of the Service

The Service provides Users with access to sophisticated artificial intelligence chatbots (“Partners”) through our website. Each chat session is conducted one-on-one between a User and a Partner. The Service does not facilitate User-to-User or User-to-administrator interactions.

3.2 Chat Features

  • Each Partner has unique characteristics and behavioral patterns
  • Users can send text messages and receive text messages and/or artificially generated images
  • All images generated by Partners are artificial and do not represent any real persons or entities
  • Sessions include a time-based memory feature for personalized experiences
  • Users can customize their experience through the My Profile section
  • Users have the ability to reset bot memory and start fresh

4. Account Creation and Management

4.1 Registration

To use the Service, you must:

  • Be at least 18 years old
  • Create an account using either:
    • Email and password
    • Google OAuth authentication

4.2 Account Restrictions

  • One user is permitted to create only one account
  • Accounts cannot be shared with or transferred to third parties
  • Multiple account creation to obtain additional free credits is prohibited

4.3 Account Security and User Responsibility

YOU ARE SOLELY RESPONSIBLE FOR:

  • Maintaining the confidentiality of your account credentials, including your password
  • All activities that occur under your account
  • Any information, data, or content you share during conversations with AI Partners
  • Immediately notifying us of any unauthorized use of your account

YOU ACKNOWLEDGE AND AGREE THAT:

  • You have the right to delete your account at any time, but any remaining credits will be forfeited without refund
  • If you share sensitive, personal, or confidential information during conversations with AI Partners, you do so at your own risk
  • We cannot guarantee the absolute security of information shared during chat sessions
  • We are not responsible for any disclosure, loss, or unauthorized access to your information resulting from:
    • Your failure to maintain account security
    • Sharing your login credentials
    • Your voluntary disclosure of personal information during chat sessions
    • Unauthorized access to your account
    • Any breach of security beyond our reasonable control

5. Credits and Payments

5.1 Credit System

  • New accounts receive 50 free credits upon creation
  • Text messages cost 1 credit each
  • Generated images cost 5 credits each
  • Credits can be purchased in packages of 100, 500, or 1000
  • Credits are non-transferable and non-refundable
  • Credits cannot be exchanged for currency

5.2 Payment Processing

  • Payments are processed through Stripe.com
  • We do not store credit card or payment information
  • Stripe’s terms of service apply (https://stripe.com/legal/consumer)

6. Privacy and Data Protection

6.1 Conversation Privacy

The Operator commits to:

  • Not share any conversation content with third parties
  • Not sell or commercialize conversation data
  • Not use conversation data for any purposes other than providing the Service

6.2 Data Deletion

Upon account deletion:

  • All conversation history will be permanently erased
  • All user data will be deleted from our systems
  • We will only retain the email address record solely for the purpose of tracking the one-time gift credit (50 credits) eligibility

7. Intellectual Property Rights

6.1 Content Ownership

  • All content generated by the Service (text and images) remains the intellectual property of Expert Comments
  • Users may not copy, transfer, or share generated content without explicit operator consent
  • Screenshots and other forms of content recording are prohibited

6.2 User Content

Users are responsible for:

  • All information sent to Partners during chat sessions
  • Ensuring they have rights to share any information they submit
  • Not sharing classified or copyrighted information

7. Service Availability and Limitations

7.1 Service Availability

  • We strive to maintain 24/7 service availability
  • The Service is currently in beta phase
  • Technical issues may occur
  • No compensation is provided for service unavailability
  • Credit compensation may be provided for incorrectly deducted credits

7.2 Access Restrictions

The Service:

  • Must be accessed through web browsers only
  • Can be used on smartphones, PCs, laptops, and tablets
  • Prohibits automated access or bot usage
  • May employ mechanisms to detect and prevent misuse

8. Disclaimers and Limitations of Liability

8.1 General Disclaimers

YOU EXPRESSLY UNDERSTAND AND AGREE THAT:

a) THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. EXPERT COMMENTS AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

b) EXPERT COMMENTS MAKES NO WARRANTY THAT (i) THE SERVICE WILL MEET YOUR REQUIREMENTS, (ii) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE, (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS, AND (v) ANY ERRORS IN THE SERVICE WILL BE CORRECTED.

8.2 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU EXPRESSLY UNDERSTAND AND AGREE THAT EXPERT COMMENTS AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS AND LICENSORS SHALL NOT BE LIABLE TO YOU FOR:

a) ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF EXPERT COMMENTS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM:

  • THE USE OR INABILITY TO USE THE SERVICE
  • UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA
  • STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE
  • ANY ACTIONS WE TAKE OR FAIL TO TAKE AS A RESULT OF COMMUNICATIONS YOU SEND TO US
  • ANY INTERACTIONS WITH AI PARTNERS OR GENERATED CONTENT
  • ANY OTHER MATTER RELATING TO THE SERVICE
  • ANY DISCLOSURE OR MISUSE OF PERSONAL, CONFIDENTIAL, OR SENSITIVE INFORMATION THAT YOU SHARE DURING CHAT SESSIONS
  • ANY UNAUTHORIZED ACCESS TO YOUR ACCOUNT OR USE OF YOUR PASSWORD
  • ANY CONSEQUENCES ARISING FROM SHARING YOUR ACCOUNT CREDENTIALS OR ALLOWING OTHERS TO ACCESS YOUR ACCOUNT

b) ANY LOSS OR DAMAGE INCURRED AS A RESULT OF:

  • THE USE OF AI-GENERATED CONTENT
  • RELIANCE PLACED BY YOU ON THE COMPLETENESS, ACCURACY OR EXISTENCE OF ANY CONTENT
  • ANY RELATIONSHIP OR INTERACTION BETWEEN YOU AND AI PARTNERS
  • ANY CHANGES WHICH EXPERT COMMENTS MAY MAKE TO THE SERVICE
  • ANY PERMANENT OR TEMPORARY CESSATION IN THE PROVISION OF THE SERVICE
  • THE DELETION OF, CORRUPTION OF, OR FAILURE TO STORE ANY CONTENT OR COMMUNICATIONS DATA
  • YOUR FAILURE TO PROVIDE EXPERT COMMENTS WITH ACCURATE ACCOUNT INFORMATION

8.3 Indemnification

YOU AGREE TO DEFEND, INDEMNIFY AND HOLD HARMLESS EXPERT COMMENTS AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, AGENTS, AND EMPLOYEES FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, OBLIGATIONS, LOSSES, LIABILITIES, COSTS OR DEBT, AND EXPENSES (INCLUDING BUT NOT LIMITED TO ATTORNEY’S FEES) ARISING FROM:

  • YOUR USE OF AND ACCESS TO THE SERVICE
  • YOUR VIOLATION OF ANY TERM OF THESE TERMS OF SERVICE
  • YOUR VIOLATION OF ANY THIRD PARTY RIGHT, INCLUDING WITHOUT LIMITATION ANY COPYRIGHT, PROPERTY, OR PRIVACY RIGHT
  • ANY CLAIM THAT YOUR CONTENT CAUSED DAMAGE TO A THIRD PARTY

8.4 Waiver of Class Actions

ANY PROCEEDINGS TO RESOLVE OR LITIGATE ANY DISPUTE IN ANY FORUM WILL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS. NEITHER YOU NOR EXPERT COMMENTS WILL SEEK TO HAVE ANY DISPUTE HEARD AS A CLASS ACTION OR IN ANY OTHER PROCEEDING IN WHICH EITHER PARTY ACTS OR PROPOSES TO ACT IN A REPRESENTATIVE CAPACITY.

8.5 Geographic Restrictions

The Service is based in the United Kingdom. We make no claims that the Service or any of its content is accessible or appropriate outside of the UK. Access to the Service may not be legal by certain persons or in certain countries. If you access the Service from outside the UK, you do so on your own initiative and are responsible for compliance with local laws.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the Service after any such changes constitutes your acceptance of the new Terms.

11. Termination

We reserve the right to terminate or suspend your account at any time for any reason, particularly for violations of these Terms. Upon termination, any remaining credits are forfeited.
